Article 3 - Powers and Authorizations
PCSAR was formed in 1973 under the auspices and sponsorship of the Rapid City-Pennington County Civil Defense District, now known as the Rapid City-Pennington County Emergency Management District. In 2011, PCSAR was placed under the authority of the Pennington County Sheriff’s Office. Under this sponsorship, PCSAR is granted the authority to operate within the jurisdiction of Pennington County.
PCSAR shall have the power to acquire and accept, by the way of gifts, purchase, lease, or otherwise, money and property of every kind, nature, and description without limitation as to the amount or value; to see or dispose of such property; to use any of its property for the above mentioned purposes, without limitation except such limitations as are imposed by this constitution or its bylaws.
PCSAR may enter into, perform, or carry out contracts with any persons, firms, association, or corporation, including but not limited to federal, state, and/or local government agencies; and to do any services necessary or proper to meet the purpose of PCSAR with such limitation as prescribed by law.
PCSAR shall not operate for profit. No part of the net earnings of PCSAR shall inure to the benefit of or be distributed to a team member or other private persons except that PCSAR shall be authorized and empowered to pay reasonable compensation for services rendered.
No loan shall be contracted on behalf of PCSAR and no evidences of indebtedness shall be issued in its name unless authorized by a resolution of the membership of PCSAR.
No substantial part of the activities of PCSAR shall be the carrying on of propaganda or otherwise attempting to influence legislation and PCSAR shall not participate in or intervene including the publishing or distribution of statements in a political campaign on behalf of any candidate for public office.
